Staying In Your Home and Qualifying For Medicaid
Our attorneys can help you determine the availability of ways for you to stay in your home and still qualify for Medicaid. Your options may include:
- MI Choice Waiver Program— Individuals who meet income and asset qualifications for the MI Choice Waiver Program can receive Medicaid as well as additional services allowing the person to avoid having to move into a nursing home. The kinds of services available may include personal care, homemaking, respite for caregivers, adult day services, home-delivered meals, transportation, private duty nursing, personal emergency response systems, chore service, counseling, home injury control, medical equipment and supplies and caregiver training.
- PACE: Pace is an option – funded by Medicare and Medicaid – for people 55 or older who wish to avoid being placed in a nursing home. PACE provides coverage for services such as prescription drugs, hospital visits, checkups, transportation and more.
- Nursing Facility TransitionServices — After an individual enters into a nursing home, qualifies for Medicaid and is later able to leave and live at home, he or she may be able to get Medicaid at home. This underutilized option offers a way to move back home or into another community-based living option.
Estate Recovery
Once the recipient of Medicaid is deceased, the state may take action through estate recovery to seek repayment for the cost of Medicaid benefits. Any real or personal property owned by the deceased at the time of death may be subject to estate recovery.
It is important to take steps now to protect your assets for the future. If you or a loved one is potentially going to be a Medicaid recipient, there may be steps that can be taken to minimize the impact of Medicaid estate recovery. Our lawyers can discuss ways in which to properly title your property so it does not go through the probate process, but still fits the Medicaid eligibility requirements.
